2. Purpose and acceptance
These Terms govern access to and use of the Trovela web and mobile app (the “Service”). By creating an account or using the Service you accept these Terms and the Privacy Policy. If you do not agree with them, do not use the Service.
3. Description of the service
Trovela offers a map of plans, places and leisure activities for families. It allows you to explore plans, save them, organise them into collections, share collections and contribute posts for possible inclusion in the catalogue. Part of the content is compiled from public social media posts.
Information about plans (opening times, prices, availability, locations) is indicative only. We recommend checking it with the venue or organiser before setting out.
4. Registration and sign-in
Signing in is done without a password, through identity providers (Google, Apple or Facebook) or through a “magic link” sent to your email address. You undertake to provide accurate information, to safeguard access to your email account and to your provider accounts, and to notify us of any unauthorised use. The account is personal and you are responsible for the activity carried out through it.
5. Minimum age and minors
To use Trovela you must be at least 14 years old. If you are a minor (under 18), you declare that you have the consent and supervision of your parents or guardians to accept these Terms. Children under 14 may not use the Service without the consent of their legal representatives.
6. Acceptable use
When using Trovela you undertake not to:
- Use the Service for unlawful purposes or purposes contrary to good faith.
- Impersonate third parties or misrepresent your identity.
- Introduce content that is unlawful or offensive or that infringes the rights of third parties.
- Attempt to gain unauthorised access to systems, accounts or data, or interfere with the operation of the Service.
- Extract data from the Service on a mass or automated basis without authorisation.
Failure to comply may lead to the suspension or cancellation of your account.
7. Contributions and user content
If you contribute content (for example, links to public posts or collections), you declare that you are entitled to do so and that it does not infringe the rights of third parties or the applicable rules. You grant us a non-exclusive, royalty-free, worldwide licence to host, reproduce and display that content for the sole purpose of providing and improving the Service. You may withdraw your content at any time. We may review, decline to publish or remove contributions that breach these Terms.
8. Intellectual and industrial property
The “Trovela” trade mark, its logo, the design of the Service, the software and the selection and arrangement of the catalogue belong to XIAO JINVEST TECHS, S.L. or to its licensors. No licence over them is granted other than the one necessary for ordinary use of the Service. Content originating from social media and third parties belongs to its respective authors.
9. Price of the service
The Service is currently provided free of charge. If we offer paid plans in the future, their terms (prices, payment method, renewal, cancellation and right of withdrawal) will be made available to you and you will have to accept them before subscribing.
10. Availability and changes to the service
We work to keep the Service available, but we do not guarantee that it will operate uninterrupted or error-free. We may modify, suspend or discontinue features of the Service for technical, legal or business reasons.
11. Exclusion of warranties and liability
The Service is provided “as is”. Information about plans is indicative and may contain errors or be out of date; we are not liable for the decisions you make on the basis of it, nor for the services provided by third parties (venues, organisers, etc.). To the extent permitted by law, Trovela shall not be liable for indirect damage. Nothing in these Terms excludes liability that cannot lawfully be excluded, in particular towards consumers.
12. Third-party links and content
The Service may include links or references to third-party sites and services. We do not control that content and assume no responsibility for it; its use is governed by each third party's terms.
13. Account closure and termination
You may close your account and delete it at any time from within the Service. We may suspend or cancel your account if you breach these Terms or the applicable rules. After closure, your data will be processed in accordance with the Privacy Policy.
14. Data protection
The processing of your personal data is governed by our Privacy Policy, which forms part of these Terms.
15. Amendments to the terms
We may update these Terms for legal, technical or service reasons. We will publish the version in force on this page together with its date. If the changes are substantial, we will let you know and, where appropriate, ask you to accept them again.
16. Governing law and dispute resolution
These Terms are governed by Spanish law. If you are a consumer, you may bring proceedings before the courts of your place of residence and use consumer dispute resolution mechanisms, such as the Juntas Arbitrales de Consumo (consumer arbitration boards) or the relevant Oficina Municipal de Información al Consumidor (OMIC, the local consumer information office).
17. Severability
If any clause of these Terms is declared void or unenforceable, the remainder will continue to be valid and will be interpreted in the way that best respects the purpose of the affected clause.
